GENERAL

Agreement to Rules: By entering the Competition, the contestant ("You") agree to comply with and abide by these Rules and the decisions of the Sponsor, and you represent and warrant that you meet the eligibility requirements. In addition, you agree to accept the Sponsor's decisions as final and binding as it relates to the content of this campaign. Entrants should look solely to the Sponsor with any questions, comments or issues related to the Competition.

Entry Period: The Competition begins on 1st February, 2022 at 12:00AM NZST and ends on 28th February, 2022 at 11:59PM NZST (the "Entry Period"). Entries submitted before or after the Entry Period will not be eligible.

How to Enter: The Competition must be entered by submitting an entry using the online sign up form provided at https://digitalboost.business.govt.nz/s/login/SelfRegister?language=en_NZ. The entry must meet all requirements of the Competition, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications of the Competition may be disqualified at the sole discretion of the Sponsor. You must provide the information requested. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. Multiple entries can be achieved by sharing the competition with friends, colleagues and family, using the functionality on this page. If you use fraudulent methods or otherwise attempt to circumvent the rules of the Competition, your submission may be disqualified at the sole discretion of the Sponsor. Government employees and contractors to the Government are not eligible to enter the Competition or win the Prize.

Prizes: There are two winners of the Digital Boost 2022 Competition (the "Winner") will receive the following prizes:  an Ice Blue Microsoft Surface Laptop 4* provided by Spark, a Digital Marketing guidance prize pack* provided by K&J Growth, and a Digital Turbo Boost package provided by Digital Boost. The appraised value of prizes may differ at time of prize award. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution shall be permitted except for at the Sponsor's discretion. The prize is non transferable. Substitution of the prize or transfer/assignment of the prize to others or request for the cash equivalent of the prize by the Winner is not permitted. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the Winner. Acceptance of the prize constitutes permission for the Sponsor to use the Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law. Odds of Winning: The odds of winning depend on the number of eligible entries received.

DIGITAL BOOST TERMS & CONDITIONS

These Terms apply to your use of the Turbo Boost 2022 Digital Transformation Prize packages from Digital Boost (as that term is defined below).  By setting up an account through the Turbo Boost 2022 Digital Transformation Prize packages from the Digital Boost competition, clicking I agree to these Terms or accessing or using the Turbo Boost 2022 Digital Transformation Prize packages from Digital Boost or the login credentials Services: you agree to these Terms; and where your access and use is on behalf of another person (e.g. a company), you confirm that you are authorised to, and do in fact, agree to these Terms on that person’s behalf and that, by agreeing to these Terms on that person’s behalf, that person is bound by these Terms.

If you do not agree to these Terms, you are not authorised to access or use the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost or the login credentials Services, and you must immediately stop doing so.

CHANGES

We may change these Terms at any time by updating them on the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost.  Unless stated otherwise, any change takes effect immediately.  You are responsible for ensuring you are familiar with the latest Terms.  By continuing to access and use the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost or the login credentials Services, you agree to be bound by the changed Terms.

We may change, suspend, discontinue, or restrict access to, the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost and/or the login credentials Services without notice or liability.

USE OF DIGITALBOOST.CO.NZ / DIGITALBOOST.BUSINESS.GOVT.NZ

You must provide true, current and complete information in your dealings with us (including when setting up an account, or if applicable, creating login credentials), and must promptly update that information as required so that the information remains true, current and complete.

You must keep your login credentials secure and: not permit any other person to use your login credentials including not disclosing or providing it to any other person; and immediately notify us if you become aware of any unauthorised use or disclosure of your login credentials, by sending an email to support@digitalboost.co.nz.

When accessing and using the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost and the login credentials Services, you and your personnel must: not impersonate another person or misrepresent authorisation to act on behalf of others or us; not attempt to undermine the security or integrity of the Underlying Systems; not use, or misuse, the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost or the Services in any way which may impair the functionality of the Underlying Systems or impair the ability of any other user to use the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost or the login credentials Services; not attempt to view, access or copy any material or data other than: that which you are authorised to access; and to the extent necessary for you to use the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost and the login credentials Services in accordance with these Terms; neither use the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost or the login credentials Services, nor transmit, input or store any Content, that breaches any third party right (including Intellectual Property Rights and privacy rights) or is Objectionable, incorrect or misleading; and unless with our agreement, access the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost and the login credentials Services via standard web browsers and apps and not by any other method.  Other methods include scraping, deep-linking, harvesting, data mining, use of a robot or spider, automation, or any similar data gathering, extraction, monitoring or input method. A breach of any of these Terms by your personnel is deemed to be a breach of these Terms by you.

You indemnify us against all Loss you suffer or incur as a direct or indirect result of: any actual or alleged claim by a third party that any Content infringes the rights of that third party (including Intellectual Property Rights and privacy rights) or that the Content is Objectionable, incorrect or misleading; your failure to comply with these Terms, including any failure of a person who accesses and uses the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost or the login credentials Services by using your login credentials; any Loss arising from or in connection with an actual or alleged breach by you of any legal or regulatory requirements which occurs as a consequence of your login credentials or as a result of a relationship established through the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost or login credentials.

COMPETITION SPECIFIC TERMS

Sponsor: The Sponsor of the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost is Digital Boost.​

Eligibility: The Turbo Boost 2022 Digital Transformation Prize package from Digital Boost by Digital Boost (the "Competition") is only open to those who sign up at https://digitalboost.business.govt.nz/ and they must comply with the sign up requirements of Digital Boost. The competition is only applicable to residents and citizens of New Zealand, and is void where prohibited by law. Employees of the Prize providers, their immediate families current customers, ‘Partners’, employees, independent contractors, interns, officers, directors, and agents of Digital Boost (the "Sponsor") their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the competition. Government employees and contractors to the Government are not eligible to enter the Competition or win the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost. The competition is subject to all applicable national laws and regulations. Void where prohibited.​

Odds of Winning: The odds of winning depend on the number of eligible entries received.​

Winner Selection and Notification: The Winner will be selected by Random Draw under the supervision of the Sponsor. The Winner will be notified within 7 days of the winner selection. The Sponsor shall have no liability for a Winner's failure to receive notices due to spam, junk e-mail or other security settings or for a Winner’s provision of incorrect or otherwise non-functioning contact information. If the Winner cannot be contacted, is ineligible, fails to claim the prize within 7 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected. Any violation of these official rules by the Winner at the Sponsor's sole discretion will result in the Winner's disqualification as winner, and all privileges as winner will be immediately terminated.​

Terms and Conditions: The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the competition should virus, bug, non-authorised human intervention, fraud, or other cause beyond the Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the competition. In such cases, the Sponsor may select a winner(s) from eligible entries received before and/or after the action taken by the Sponsor if appropriate. The Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the competition or website or violates these Terms & Conditions. The Sponsor has the right, in its sole discretion, to maintain the integrity of the competition, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by competition rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the competition may be a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages to the fullest extent permitted by law.​

Limitation of Liability: By entering the competition you agree to release and hold harmless Digital Boost and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the competition and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) unauthorised human intervention in any part of the competition; (iii) electronic or human error in the administration of the competition or the processing of entries; (iv) technical errors of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (v) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vi) printing errors; (vii) lost, late, postage due, misdirected, or undeliverable mail.​

Disputes: This competition is governed by the laws of New Zealand, without respect to conflict of law doctrines. By participating in this Competition, you agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Competition, shall be resolved individually, without resort to any form of class action, exclusively before a court located in New Zealand having jurisdiction. Further, in any such dispute, under no circumstances shall You be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than actual out-of-pocket expenses (i.e. costs associated with entering the competition). You further waive all rights to have damages multiplied or increased.​

Winners List: To request a copy of the winners list please contact the Sponsor. Requests must be sent within four (4) weeks of the end of the Entry Period and winners will be announced in the Digital Boost weekly email to registered users and will be contacted individually via email or telephoned, if number has been added to the winners Digital Boost personal profile.

All entries become the property of the Sponsor, The Mind Lab and The Ministry of Business, Innovation & Employment and may be used for promotional and marketing purposes, or passed onto a third party involved in the promotion for their marketing purposes.​

The Sponsor is not liable for damage to prizes sent by post or courier.​

The competition is in no way sponsored, endorsed, administered by, or associated with Facebook, Twitter, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn or any other social networks that are used to share the competition. You understand that you are providing your information to the owner of the competition and not to Facebook, Twitter, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn or any other social networks.​

Acceptance of Rules: By participating in the competition, You have affirmatively reviewed, accepted, and agreed to all of the Official Rules, Terms and Conditions.

PRIVACY

When you provide personal information to us, we will comply with the New Zealand Privacy Act 2020 and with our privacy policy set out at https://digitalboost.business.govt.nz/s/privacy

DISCLAIMERS

To the extent permitted by law, we and our licensors have no liability or responsibility to you or any other person for any Loss in connection with: any login credentials; any relationship established through the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost or a login credentials;​

The Turbo Boost 2022 Digital Transformation Prize package from Digital Boost or the login credentials Services being unavailable (in whole or in part) or performing slowly; any error in, or omission from, any information made available through the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost or a login credentials; any exposure to viruses or other forms of interference which may damage your computer system or expose you to fraud when you access or use the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost or the login credentials Services. To avoid doubt, you are responsible for ensuring the process by which you access and use the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost and the login credentials Services protects you from this; and any site linked from the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost. Any link on the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost to other sites does not imply any endorsement, approval or recommendation of, or responsibility for, those sites or their contents, operations, products or operators. ​

Except to the extent permitted by law, nothing in these Terms has the effect of contracting out of the New Zealand Consumer Guarantees Act 1993 or any other consumer protection law that cannot be excluded. To the extent our liability cannot be excluded but can be limited, our liability will be limited to NZD10.

LIABILITY

To the maximum extent permitted by law: your access and use of the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost, the login credentials Services and login credentials at your own risk; and we are not liable or responsible to you or any other person for any Loss under these Terms or in connection with the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost, the login credentials Services, any login credentials or your access and use of (or inability to access or use) the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost, the login credentials Services or any login credentials.  This exclusion applies regardless of whether our liability or responsibility arises in contract, tort (including negligence), equity, breach of statutory duty, or otherwise.​

To the maximum extent permitted by law, and only to the extent the liability exclusion set out in the paragraph above does not apply, our total liability to you under these Terms or in connection with the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost, the login credentials Services or any login credentials will not exceed NZD10.  The cap in this paragraph includes the cap of NZD10 set out in the section titled DISCLAIMERS above.​

We will not be liable to you under or in connection with these Terms, the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost, the login credentials Services or any login credentials for any: loss of profit, revenue, savings, business, use, data (including Content), and/or goodwill; or consequential, indirect, incidental or special damage or loss of any kind.​

The liability exclusions set out above do not apply to limit: our liability under or in connection with these Terms: for personal injury or death; or for fraud or wilful misconduct; or any liability that cannot be excluded by law.

SUSPENSION AND TERMINATION

If you are using: unless terminated as set out below, these Terms and your right to access and use the login credentials Services continues until a party gives 30 days’ notice that these Terms and your access to and use of the login credentials Services will terminate on the expiry of that notice; and you can cease using the login credentials at any time by removing your account for the login credentials Services. If you do this, these Terms and your right to use the login credentials Services will terminate immediately.   ​

Without prejudice to any other right or remedy available to us, if we consider that you have breached these Terms or we otherwise consider it appropriate, we may immediately, and without notice, suspend or terminate your access to the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost or the login credentials Services (or any part of them).​

On suspension or termination, you must immediately cease using the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost and the login credentials Services and must not attempt to gain further access.​

Termination of these Terms does not affect either party’s rights and obligations that accrued before that termination.​

No compensation is payable by us to you as a result of termination of these Terms for whatever reason.   ​

Without limiting any other right or remedy available to us, we may restrict or suspend your use of the login credentials Services and/or delete, edit or remove your Content if we consider that you or any of your personnel have: undermined, or attempted to undermine, the security or integrity of the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost or the login credentials Services or any Underlying Systems; used, or attempted to use, the Turbo Boost 2022 Digital Transformation Prize package from Digital Boost or the login credentials Services for improper purposes (including failure to comply with the Unsolicited Electronic Messaging Act 2007); your Content breaches or may breach these Terms or any third party right (including Intellectual Property Rights and privacy rights), or is or may be Objectionable, incorrect or misleading; or otherwise materially breached these Terms.

K&J GROWTH TERMS AND CONDITIONS 

K&J Growth has partnered with the Sponsor for the provision of prizes to the Winner.

Within seven (7) days of the Winner selection, K&J Growth will contact the Winner by email or phone, outlining instructions for how to redeem the prize. The Winner will then have a one (1) month period from such notification to redeem the prize. Any prizes that remain unclaimed after the one (1) month period will be forfeited.

The winner will receive a 30 minute Zoom consultation with Q+A, sales and marketing funnel review, social media review, landing page design and development, advertising creative direction, 30 minute closing digital marketing strategy consultation, and will be providing a $500 A/B test budget for Facebook ad spend. Ad spend may not be redeemed for cash. K&J Growth will be working alongside the winners' existing infrastructure. K&J Growth will not be developing or responsible for the cost of developing the winners' digital infrastructure.

Prize pack and consultations from K&J Growth will be completed within a 1 month period.

DIGITAL BOOST TURBO BOOST 2022 TERMS AND CONDITIONS

Digital Boost is the provider of Digital Turbo Boost Strategy package to the Winner.

The winner will receive a Zoom consultation with an individual Q+A with a member of the Digital Boost Support team, including a detailed review of the digital footprint such as business website, digital marketing, branding, digital tools and copywriting. The Digital Boost Team will work with the winner to deliver on an actionable plan. This excludes any hosting costs which will be the responsibility of the winner.

The prize pack from Digital Boost will be available over a one month period, agreed by both the winner and the Digital Boost team.
